These Terms of Service apply to purchases through teacreator.nl and to the use of this website. They form a practical legal basis but are not a substitute for advice or review by a qualified legal professional. Mandatory consumer rights under Dutch and EU law remain unaffected.

2. Scope
These terms apply to offers, orders, and agreements between Tea Creator and its customers through this website. Consumers are individuals acting for purposes outside their trade, business, craft, or profession. Additional or different arrangements for business customers apply only when agreed in writing.
3. Product information and minimum quantity
We aim to present products, images, availability, characteristics, and prices accurately. Minor variations that do not affect conformity may occur, for example because of screen settings or the natural character of a product. The minimum purchase quantity for tea is 250 grams, including for consumers. Any genuine exception will be clearly stated on the relevant product page.
We do not intend website content to constitute medical or health advice. Product-specific preparation and storage information, where provided, should be followed.
4. Offers, prices, and taxes
Prices shown on the website are in euros and include applicable VAT for consumers unless clearly stated otherwise. Shipping costs are shown separately before the order is placed. Obvious errors or mistakes do not bind Tea Creator where the customer knew or reasonably should have known that the information was incorrect.
5. Ordering and formation of the agreement
You can review and correct your order before submitting it. An agreement is formed when Tea Creator accepts the order, normally by sending an order confirmation, subject to mandatory law. We may refuse or cancel an order on reasonable grounds, such as an obvious pricing error, suspected fraud, legal restrictions, or lack of availability. If payment has already been received for a cancelled order, the amount concerned will be refunded without undue delay.
6. Payment
Available payment methods are shown during checkout. Payment must be made using one of those methods. Tea Creator does not receive full card or bank credentials where payment is processed by an external payment provider. Any payment-provider terms may also apply without limiting your statutory rights against Tea Creator.
7. Delivery
Tea Creator sells and delivers to EU countries. Products in stock are normally dispatched within 48 hours after payment is received. Delivery times are estimates unless a binding date has been expressly agreed. Shipping costs depend on the destination country and shipment weight and are based on applicable PostNL rates. If an item is unexpectedly unavailable, we will contact you and communicate a new expected dispatch or delivery date. Statutory rights regarding late or failed delivery remain unaffected.
8. Right of withdrawal and returns
Consumers generally have a 14-day right of withdrawal. The notification process, return deadline, return costs, refunds, and the careful application of any statutory exception for sealed food products are described in our Refund and Return Policy. Nothing in these terms limits mandatory rights concerning wrong, damaged, defective, unsafe, or otherwise non-conforming products.
9. Conformity and complaints
Products must conform to the agreement and applicable legal requirements. If a product is wrong, damaged, defective, or otherwise non-conforming, contact info@teacreator.nl promptly with the order number, a description of the issue, and clear photographs where useful. Tea Creator will provide an appropriate remedy under applicable law and cover reasonable return costs where Tea Creator is responsible.
Submitting a complaint within a reasonable time helps us investigate, but does not remove mandatory consumer rights merely because a specific voluntary complaint period has passed.
10. Use of the website
You may use the website only for lawful purposes. You must not interfere with its operation, attempt unauthorised access, introduce malicious code, scrape the website in a way that disrupts the service, or use the website to infringe the rights of others.
11. Intellectual property
Website content, branding, text, photographs, graphics, and other materials may be protected by intellectual-property rights belonging to Tea Creator or its licensors. You may use the website for personal, non-commercial shopping purposes. No rights are transferred except where expressly stated or required by law.
12. Third-party services and links
The website may use or link to third-party services, including payment, delivery, and platform services. Tea Creator is not responsible for independent third-party websites or content. This does not limit Tea Creator’s responsibility for parties it uses to perform its obligations, such as delivery to the consumer.
13. Liability
Tea Creator is responsible for loss where and to the extent required by applicable law. Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for intent or deliberate recklessness, death or personal injury caused by negligence, product liability where applicable, or breach of mandatory consumer rights.
For business customers only, and to the extent permitted by law, liability may be limited to direct loss that was reasonably foreseeable and to the amount paid for the relevant order, except where such limitation is unlawful or otherwise expressly agreed.
14. Force majeure
Neither party is liable for delay or failure caused by circumstances beyond its reasonable control, to the extent permitted by law. Tea Creator will inform the customer where such circumstances materially affect performance. Mandatory consumer rights, including rights where performance becomes impossible or excessively delayed, remain unaffected.
15. Privacy and cookies
Personal data is processed as described in our Privacy Policy. Cookie choices can be reviewed through the Cookie preferences link in the footer.
16. Changes to these terms
We may update these terms for future orders, for example because of legal, technical, or operational changes. The terms that applied when an order was placed continue to govern that order unless a change is required by law or agreed with the customer.
17. Governing law and disputes
Dutch law applies, without depriving consumers residing in another EU country of mandatory protections provided by the law of their country of residence. Disputes may be submitted to a competent court. Consumers may also use available statutory or recognised out-of-court complaint mechanisms. Any choice of court in these terms does not limit a consumer’s mandatory right to bring proceedings in another competent court.
18. Severability
If any provision is invalid or unenforceable, the remaining provisions remain effective. The invalid provision will be replaced only to the extent permitted by applicable law and in a way that most closely reflects its lawful purpose.
